These Terms & Conditions ("Terms") govern your access to and use of the Pharma Mithra website, applications and services (together, the "Platform"), operated by [Operating Legal Entity — insert registered company name] ("Pharma Mithra", "we", "us" or "our"). By creating an account, verifying your mobile number, or otherwise using the Platform, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Platform.
1. What Pharma Mithra does, and why
Pharma Mithra is an informational regulatory-compliance tool for business (B2B) users — pharmaceutical manufacturers, distributors, wholesalers, pharmacies and other regulated trade participants. Its sole purpose is to help you meet your own compliance obligations by looking up and confirming publicly-available regulatory information — such as drug licences, GST registrations and FSSAI licences — about the counterparties you deal with in the ordinary course of business, so that dealings with unlicensed, lapsed or non-compliant parties (and the resulting drug-law violations) are reduced. The Platform retrieves such information from official government records and trusted data sources and presents it in a convenient form. It is a facilitator and aggregator only.
Pharma Mithra is not a government body, is not affiliated with, endorsed by, or an official partner of CDSCO, GSTN, FSSAI, any State Drugs Control Administration or any other government department or regulatory authority, and does not issue, grant, amend, validate, certify or maintain any licence, registration or approval. It reports the status of third-party records only.
Pharma Mithra is a commercial B2B service that helps businesses verify the licensing and compliance status of their trading counterparties, so they can meet their own statutory verification obligations (including under the Drugs and Cosmetics Act, 1940 and the Drugs Rules, 1945) and reduce dealing in unlicensed or sub-standard stock. We offer a free tier. Paid tiers are priced by verification volume — because each verification consumes processing, bandwidth and storage that scale with usage — and include value-added features (dashboards, expiry and recall alerts, on-demand re-verification, bulk verification, API access and reports). Fees fund this infrastructure and these features. We do not sell, resell, sub-licence or commercially exploit the underlying government records themselves; these are public records that the issuing authorities are expected to make verifiable.
2. No guarantee of accuracy; not a substitute for official verification
The information shown on the Platform originates from official government records and/or licensed third-party data sources, is shown together with a "last verified" date/time, and is provided on an "as is" and "as available" basis. Records may be updated, corrected or withdrawn at source at any time, and results may be cached for short periods. While we take reasonable care, we do not warrant that any result is accurate, complete, current, or free from error, nor that a source will be reachable at any given time. Source portals may be delayed, offline, or may themselves contain errors. You must independently confirm any information directly with the relevant authority or the counterparty's original documents before relying on it for any transaction, purchase, sale, onboarding or legal/compliance decision, and you may use the re-verify option to obtain the latest available status. A verification result is not a certificate, endorsement, or legal proof of a party's status.
3. Not professional or legal advice
Content and results on the Platform are for general information only and do not constitute legal, regulatory, tax, financial or professional advice. You are solely responsible for your own compliance obligations and business decisions.
4. Eligibility & account
You must be at least 18 years old and use the Platform for legitimate business purposes. You agree to provide accurate registration information and to keep it updated. You are responsible for all activity under your account and for maintaining the confidentiality of the mobile number and one-time passwords used to access it. One account is intended for one business user; accounts may not be shared.
5. Acceptable use
You agree that you will not, and will not permit any third party to:
- scrape, crawl, harvest, bulk-download, resell, redistribute or commercially exploit the Platform or its results, or build a competing or derivative dataset/service;
- access the Platform through any automated means, bots, or scripts, or attempt to circumvent verification limits, rate limits, plan restrictions or security controls;
- use the Platform for any unlawful, fraudulent, harassing or infringing purpose, or to make decisions that unlawfully discriminate against any person;
- submit data you are not authorised to submit, or infringe the privacy or rights of any third party;
- interfere with, overload, or disrupt the Platform, its infrastructure, or the source portals it relies on.
6. Fair usage
Verification volumes are subject to your plan and to fair-usage limits. Even on plans described as "unlimited", usage must be reasonable and consistent with ordinary single-business use. We may apply rate limits and may throttle, suspend, or terminate accounts that we reasonably believe are abusing the service, generating excessive load, or engaging in automated or bulk access.
7. Plans, payments & refunds
Paid plans, prices and included verification quotas are as shown on the Platform and may be revised from time to time. Payments are processed by our third-party payment provider; we do not store your card details. Paid plans are one-time purchases for the stated period and do not auto-renew unless expressly stated. Except where required by law, fees are non-refundable, including for verifications already consumed or for periods during which a third-party source was temporarily unavailable. Promotional/limited-period prices apply only for the stated offer.
8. Intellectual property
The Platform, its software, design, and branding are owned by us or our licensors and are protected by law. Underlying regulatory data remains the property of the respective authorities. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Platform for your internal business purposes in accordance with these Terms.
9. Limitation of liability
To the maximum extent permitted by law, the Platform is provided without warranties of any kind. We shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, business, goodwill, stock, or data, arising out of or in connection with your use of (or inability to use) the Platform or any reliance on its results, even if advised of the possibility. Our total aggregate liability for any claim relating to the Platform shall not exceed the amount you paid to us for the service in the three (3) months preceding the event giving rise to the claim.
10. Indemnity
You agree to indemnify and hold us harmless from any claim, loss, liability or expense (including reasonable legal fees) arising from your misuse of the Platform, your breach of these Terms, or your reliance on any verification result.
11. Suspension & termination
We may suspend or terminate your access at any time, with or without notice, if you breach these Terms or if we reasonably believe your use poses a risk to the Platform, its sources, or other users. You may stop using the Platform at any time.
12. Changes to the service and to these Terms
We may modify, add, or discontinue features (including states, verification types, or sources) at any time. We may update these Terms from time to time; the "Last updated" date will change and continued use after an update constitutes acceptance of the revised Terms.
13. Governing law & jurisdiction
These Terms are governed by the laws of India. Subject to any mandatory consumer-protection rights, the courts at [insert city, e.g. Hyderabad], India shall have exclusive jurisdiction over any dispute.
14. Recall, NSQ & spurious-drug information
Drug-recall, Not-of-Standard-Quality (NSQ) and spurious/counterfeit-drug information shown on the Platform is reproduced from lists published by CDSCO and other competent authorities, is attributed to and dated by reference to the source publication, and is batch-specific. These are the classifications of the publishing authority and may be revised or withdrawn by it. Pharma Mithra republishes this information in the public interest of drug safety and does not itself allege wrongdoing by any manufacturer or marketer. If you are a manufacturer, marketer or other affected party and believe an entry is incorrect, out of date, wrongly attributed to you, or has since been resolved, contact grievance@pharmamithra.com and we will review it and, where appropriate, correct, update or remove it promptly under our correction/takedown process.
